Terms of Service

1. Agreement to terms
These Terms of Service ("Terms") govern your access to and use of the FocusConductor macOS application ("App") and the website at focusconductor.app ("Site"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not install or use the App.
2. License grant
Subject to these Terms and your active subscription (if required), we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices you own or control, solely for your own personal or internal business use.
If you obtained the App through the Mac App Store, Apple's Licensed Application End User License Agreement (LAEULA) also applies and, to the extent it conflicts with these Terms, the LAEULA controls. You acknowledge that the agreement is between you and FocusConductor; Apple is not a party to these Terms and is not responsible for the App or its content.
3. Subscriptions and billing
FocusConductor is offered as an auto-renewing subscription with the following plans:
- Monthly — US$2.99 per month
- Yearly — US$19.99 per year
Both plans start with a 14-day free trial. Prices in other regions are set by Apple at the time of purchase. Payment is charged to your Apple ID account at confirmation of purchase and automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current period.
You can manage your subscription or turn off auto-renewal at any time from System Settings → Apple ID → Media & Purchases → Subscriptions.
4. Refunds
All purchases and refunds are processed by Apple. To request a refund, visit reportaproblem.apple.com, sign in with your Apple ID, find FocusConductor in your purchase history, and choose "Request a refund". We have no access to your payment details and cannot issue refunds directly. If you believe something is wrong on our end, email support@focusconductor.app and we'll do what we can to help.
5. Acceptable use
You agree not to:
- Reverse engineer, decompile, or disassemble the App, except to the extent permitted by applicable law;
- Remove or alter any proprietary notices in the App;
- Use the App to violate any law or infringe anyone's rights;
- Circumvent subscription entitlement checks or tamper with the subscription validation mechanism;
- Resell, sublicense, or redistribute the App to third parties.
6. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
FocusConductor depends on macOS Focus APIs provided by Apple. Changes to those APIs by Apple may affect functionality and are outside our control.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FOCUSCONDUCTOR, ITS CONTRIBUTORS, OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US (OR APPLE, ON OUR BEHALF) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
8. Termination
These Terms remain in effect until terminated. You may stop using the App at any time by uninstalling it and cancelling your subscription. We may suspend or terminate your access to the App if you breach these Terms. Sections 6, 7, and 10 survive termination.
9. Changes to these Terms
We may update these Terms as the App evolves. When we do, we will update the "Last updated" date at the top of this page. Continued use of FocusConductor after a change constitutes acceptance of the updated Terms.
10. Governing law
These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict-of-law principles. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of France, except where mandatory consumer-protection law requires otherwise.
